The Ready Set Row® LLC Privacy Statement is set out in a separate page and confirms how we use data relating to you and it forms part of these Terms and Conditions.

These Terms and Conditions describe the terms on which you are permitted to use this Site.

Separate legal terms apply to purchases made via this Site.

These Terms may change from time and the terms in force will be displayed on this page.

By visiting www.readysetrow.com, www.rsrelite.com, www.rsrboathouse.com (and other sites operated by Ready Set Row LLC) you are consenting to our Terms and Conditions as set out below. Should you not wish to accept the Terms and Conditions of this Site in full you should cease using this Site immediately.

This website, www.readysetrow.com and other sites operated by Ready Set Row, LLC, will be referred to as the “Site”. All visitors to the Site will be referred to as “User” “You” or “Your”. As a user, you will be bound by these Terms of Use which may also be referred to from time to time as Terms and Conditions or “Terms”. The terms “We,” “Us,” and “Our” refer to Ready Set Row, LLC. Accessing and using the Site constitutes acceptance of the Terms of Use.

By using this Site you agree to the Terms and Conditions without modification, limitation or qualification and acknowledge that any other agreements between you and the Site are superseded and of no force or effect. We reserve the right to amend the Terms of Use of this Site and on doing so we will update these Terms and Conditions.

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them. This Site is intended for use by persons who are a minimum of 18 years old, and for those under age 18 with direct Parent/Guardian approval and supervision.

You must not copy, share or disseminate the information on this site which is subject to copyright for which all rights are reserved.

This Site is directed to people residing in the United States. We do not represent that the content will be available or appropriate in other locations. This Site is written in English and we do not take responsibility for any translations which are applied to this Site.

In using this Site you may encounter comments and/or content supplied by other users. The information contained within user comments is not verified or approved by us. The views expressed by other users on the Site do not represent our views or values.

TERMS
The content on this Site, and the associated social media channels (via @readysetrow) and email marketing, will include information on camps, clinics, virtual coaching and virtual membership material. All content is intended for informational purposes only. Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

None of the content in emails, blog posts or social media posts should be construed as specific medical advice including but not limited to physical and mental health information.

In addition to these Terms of Use please be aware of our Privacy Policy and Terms and Conditions of Sale which include key terms which are set out separately on our Site.

SITE OPERATION
This Site is available free of charge (with limited exceptions).

We do not guarantee the availability of any Site or content. We reserve all rights to withdraw, suspend or restrict the content at any time for any reasons. Where possible, we will give you reasonable notice if the Site is to be suspended.

We do not guarantee that this Site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software.

PRIVACY POLICY
Our business has a privacy policy. The key elements of that policy are set out on this Site in our Privacy Statement, last updated November 8, 2022. The Privacy Statement can be found at the bottom of our website.

INTELLECTUAL PROPERTY RIGHTS
This Site contains intellectual property created and owned by Ready Set Row LLC unless otherwise stated. The Intellectual Property includes all content on the Site. Content means any text, graphics, audio and video and also extends to the page layouts of this Site and any social media channels and emails. All photographs and videos on this website and the connected social media channels @readysetrow are subject to copyright and are protected by copyright laws, and treaties around the world. All such rights are reserved.

You may not use our intellectual property in any way. This includes but is not limited to republishing or sharing any text, graphics, audio and video and also extends to the page layouts of this Site and any social media channels and emails. You must not modify the paper or digital copies of any materials you have printed, copied, or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not add any illustrations, photographs, video, or audio sequences to our content and then redistribute in any way.

You must not share printed or downloaded copyrighted content with any non-members of the Site including the RSR Boathouse.

Should you wish to utilize the content on this Site please contact info@readysetrow.com to make your request. You must receive written permission to repurpose, copy and/or modify any content on this Site, or content which is shared to you by email, on social media or in the RSR Boathouse.

If you are granted permission to share content from this Site or our social media channels, our status (and that of any identified contributors) as the authors of material on our Site must always be acknowledged.
You must not use any part of the materials on our Site for commercial purposes without obtaining a license to do so from us.

LIABILITY
The material displayed on our Site is provided without any guarantees, conditions or warranties as to its accuracy or completeness. To the extent permitted by law, We, other members of our group of companies and third parties connected to us, hereby expressly exclude:

  • all conditions, warranties and other terms which might otherwise be implied by statute, law or otherwise;
  • any liability whatsoever incurred by any user in connection with our Site or in connection with the use, inability to use, or results of the use of our Site, any sites linked to it and any materials posted on it, including, without limitation any liability for:
    • direct, indirect or consequential loss or damage;
    • loss of income or revenue;
    • loss of business;
    • loss of profits or contracts;
    • loss of anticipated savings;
    • loss of data;
    • loss of goodwill;
    • wasted management or office time; and
    • for any other loss or damage of any kind, however arising and whether caused by infringement of general laws (including the omission to act in accordance with reasonable carefulness), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

REFUND POLICY
Should you decide to purchase a virtual coaching programme or any personalized product from this Site then you will enter into a contract of sale with us at the point of sale. If you change your mind about purchasing you are entitled to a refund for the 14 days following the purchase minus transaction fees. 

If you make an electronic purchase then you will be sent a link for a direct download. At the point of purchase, you will be asked to confirm your express consent to receiving the download immediately. In agreeing to receive the download at the point of purchase you will lose your right to cancel and your right to a refund.

Should you have any questions about your virtual product purchase we will be happy to assist.

Every athlete who pays an application for RSR Elite is not eligible for a refund for that application.

Every athlete who registers for an in-person Ready Set Row Camp, Clinic or Program will pay the full cost which includes a non-refundable deposit of 30% of the program fee. All athletes and guardians will be notified for additional payment. Any athlete who needs to withdraw must notify the Ready Set Row staff by email only (info@readysetrow.com) and must include the following information: Athlete’s Name, Amount of Money Paid, Name for Refund Check, Email and Mailing Address for Refund Check and Reason for Withdrawal. You will receive a confirmation from Ready Set Row if you send this email. 100% of the remaining balance will be refunded up to 60 days before the camp, clinic or program. 25% of the remaining balance minus transaction fees will be refunded up to 30 days prior to the camp, clinic or program. No refunds will be offered in the last 30 days prior to a camp, clinic or program, and no refunds will be offered for “no show” athletes and/or those who fail to notify Ready Set Row of any change in plans.

Once a program commences, there are no refunds. Any athletes sent home due to illness, injury, inappropriate behavior, or homesickness are not eligible for a refund. Injured athletes may stay at camps or clinics despite their injury to learn through observation. These athletes will need approval from a Doctor.
For summer athletes who register for the RSR Elite Racing Team who are then formally invited to the USRowing Junior National Team Selection Team for Junior Worlds in Chula Vista, CA we will offer you a refund after deducting $1500 for cost and fees incurred. This refund is the for the Selection Team ONLY - it does not include any other USRowing camp such as Selection Development Camp (SDC) or Youth Development Camp (YDP) or any other rowing camp. 

We strongly encourage all athletes to purchase travel insurance especially if you intend to apply to the US Rowing Selection Team with a "cancel for any reason" package so protect your investments. 

The RSR Boathouse offers a full-money back guarantee in the first 30 days of any JV or Varsity membership. After 30 days, a membership can be canceled at any time and if a year membership was purchased, the refund will be prorated and the balance minus transaction fees will be refunded.

Not all workouts shared are suitable for all experience levels. If you are new to exercise, pregnant or have given birth within the last six months, or have recently been injured you should consult a medical professional before taking part in any physical exercise and follow their advice.

Although reasonable efforts are made to update the information on this Site, we make no representations, warranties or guarantees, whether expressed or implied, that the content on our Site is accurate, complete or up to date.

The content on this Site does not constitute custom coaching, personal training, nutritional coaching or mental health advice. Should you require advice under any of these topics then you should contact us about one-on-one coaching or a professional directly to work one-on-one. Viewing the information on this Site does not constitute a contractual relationship between you and us.

These Terms are governed by the laws of the state of North Carolina and the United States of America. The Courts have exclusive jurisdiction for any matter and proceedings arising out of the use of this Site.

It is intended that all disputes can be resolved with good faith between the parties. Should it not be possible to resolve a dispute then the dispute shall be referred to mediation.

We may report any breach under these Terms of Use to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any site linked to it.
